Bankruptcy annulment

Bankruptcy can have significant financial and legal consequences, but under certain circumstances, a person can apply to annul (cancel) the bankruptcy order, effectively restoring them to their pre-bankruptcy status.

This is a brief overview of when and how annulment can be obtained.

Grounds for bankruptcy annulment

There are a few primary situations where a court may annul a bankruptcy order:

  1. The most common route is paying off all bankruptcy related debts, including court fees, bankruptcy expenses, and interest where applicable. This allows the bankrupt individual to apply to the court for annulment based on financial solvency.

  2. If the bankruptcy order was made in error (e.g., procedural mistakes, a debt incorrectly calculated, or the debt threshold not met), the court has the power to annul the order. This requires strong evidence of procedural flaws or that the debt was invalid from the outset.

  3. If the bankrupt arranges an IVA or similar agreement approved by creditors, this can allow annulment. The IVA structure provides an agreed schedule of repayments, often extending over five years, to resolve the debt outside of bankruptcy.

  4. If an individual successfully appeals the bankruptcy order in court, the annulment is granted automatically upon a successful appeal.

Process and considerations

Applying for an annulment involves obtaining a court order, which can be a complex process. It’s generally advisable to work with a legal professional experienced in bankruptcy law to ensure the case is well documented by the time it is presented to the court.

Potential implications and benefits

An annulment legally treats the bankruptcy as though it never occurred, removing certain restrictions on the bankrupt, such as the ability to act as a company director.

However, actions taken during bankruptcy, such as the sale of assets by the Official Receiver, remain valid. It's crucial to act quickly as the longer the bankruptcy order is active, the more complex it may be to resolve or annul.

Overall, an annulment can offer a fresh start, but the circumstances must be right and the procedural requirements must be followed.
